These Terms of Use (the “Terms”) set out the conditions for using the app “LocalMarks” for macOS and Windows and its Chrome extension (together, the “App”) provided by Daisuke Takayama (webcyou, “we”).
This English version is a translation provided for convenience. If there is any difference between this version and the Japanese version, the Japanese version prevails.
1. Scope
These Terms apply to everyone who uses the App (“you”). The app is distributed through the Mac App Store and the Microsoft Store. Matters not covered by these Terms are governed by Apple’s Licensed Application End User License Agreement if you obtained the app from the Mac App Store, or by Microsoft’s Standard Application License Terms if you obtained it from the Microsoft Store. The Chrome extension is distributed through the Chrome Web Store.
2. In-app purchases
You can save up to 50 articles for free. Purchasing “Unlimited”, a one-time in-app purchase, removes the limit. Purchases and refunds are subject to Apple’s terms for the macOS version and Microsoft’s terms for the Windows version. You can restore your purchase on any computer signed in with the same Apple ID or Microsoft account by using Restore Purchase.
3. Web pages you save
Please use the content of the web pages you save with the App only to the extent permitted by law and by each website’s terms, such as for private use. We are not responsible for how you use saved content.
4. Managing your data
The articles you save are stored only on your computer, and we cannot keep or recover them for you. You are responsible for keeping copies of important data, for example by using the App’s backup feature.
5. Prohibited conduct
You must not:
- Violate any law or public order and morals
- Infringe the copyright or any other rights of third parties
- Cause trouble for others, such as by placing an excessive load on websites
- Modify, reverse engineer or redistribute the App, except as permitted by law
6. Intellectual property
The copyright and other intellectual property rights in the App belong to us or to their rightful owners. Open-source software included in the App is subject to its respective licenses.
7. Disclaimer
We do not guarantee that the App can correctly save or display every web page, or that the App is free of defects. We are not liable for any damage you suffer from using the App (including loss of data), except in cases of our willful misconduct or gross negligence.
8. Changes to or discontinuation of the App
We may change the contents of the App or stop providing it.
9. Changes to these Terms
We may change these Terms as necessary. The revised Terms take effect when they are posted on this page.
10. Governing law and jurisdiction
These Terms are governed by the laws of Japan. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location as the court of first instance.
